In accordance with the requirements of Title II of the Americans with Disabilities Act (ADA) of 1990, as amended, the City of Arlington, Texas, will not discriminate against qualified individuals with disabilities on the basis of disability in its services, programs, or activities.

The Transportation Department will make all reasonable efforts to maintain accessible paths to and from ramps and lifts on our vehicles and to and from sidewalks and driveways, as necessary for our riders to use our services and reach their destinations. If, for some reason, an accessible path is blocked, Department staff will seek alternative means to accommodate individuals otherwise using the path. 

For purposes of Sec. 37.101 and 37.103 of this part, a fixed route system or demand responsive system, when viewed in its entirety, shall be deemed to provide equivalent service if the service available to individuals with disabilities, including individuals who use wheelchairs, is provided in the most integrated setting appropriate to the needs of the individual and is equivalent to the service provided other individuals with respect to the following service characteristics:

(a) (1) Schedules/headways (if the system is fixed route);
(2) Response time (if the system is demand responsive);
(b) Fares;
(c) Geographic area of service;
(d) Hours and days of service;
(e) Availability of information;
(f) Reservations capability (if the system is demand responsive);
(g) Any constraints on capacity or service availability;
(h) Restrictions priorities based on trip purpose (if the system is demand responsive).

Employment

The City of Arlington does not discriminate on the basis of disability in its hiring or employment practices and complies with all regulations promulgated by the U.S. Equal Employment Opportunity Commission under Title I of the ADA.

Effective Communication

The City of Arlington will generally, upon request, provide appropriate auxiliary aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in City of Arlington programs, services, and activities. Auxiliary aids may include qualified sign language interpreters, documents in alternative formats, including Braille, and other ways of making information and communications accessible to persons with speech, hearing, or vision impairments.

Modifications to Policies and Procedures

The City of Arlington will make all reasonable modifications to policies and procedures to ensure that individuals with qualified disabilities have an equal opportunity to enjoy all City of Arlington programs, services, or activities. For example, individuals with service animals are welcomed in City of Arlington offices, even where pets are generally prohibited.

Individuals requiring auxiliary aids or services for effective communication, or a modification of policies or procedures to participate in a City of Arlington program, service, or activity, should contact the City of Arlington ADA Coordinator, 101 West Abram Street, Arlington, TX 76010, 817-459-6550, or via email as soon as possible but not later than 72 hours prior to the start of the scheduled program, service, or activity.

The ADA does not require the City of Arlington to take any action that would fundamentally alter the nature of its programs, services, or activities, or impose an undue financial or administrative burden.

Complaints or Grievances

The City of Arlington will retain ADA-related complaints for at least one year and a summary of all ADA-related complaints for at least five years.
